Layburn Hodgins complies with the New Zealand Privacy Act 2020 (the Act) when dealing with your personal information. Personal information is information about an individual which can be used to identify that individual.
This policy sets out how we will collect, use, disclose and protect your personal information. It should be read in conjunction with our Terms of Engagement and/or Credit Policy/Website Terms.

Changes to the Policy๐
We may review this policy from time to time to take account of changes in laws and technology and changes to our business operations. Any changes to this policy will be uploaded as a revised policy onto our website and the change will apply from the date that we upload the revised policy.

We collect personal information from :
- You, when you provide that personal information to us;
- Third parties where you have authorised this or the information is publicly available.
What types of information does Layburn Hodgins collect?๐
In general, the types of information Layburn Hodgins collects and holds includes (but is not limited to) names, addresses, contact details, occupations, date of birth, work information, billing information, IRD number, identification documents, financial information (including information required under Anti Money Laundering and Countering Financing of Terrorism legislation), employment history/education/qualifications, and any other information that is required by us in conducting our business, providing and marketing our services and meeting our legal obligations.
If personal information that Layburn Hodgins requests is not provided, we may not be able to supply you with the relevant service or product you have engaged us to supply.
How do we collect your personal information?๐
Layburn Hodgins will generally collect personal information from you by way of (but not limited to), face-to-face meetings, forms filled in by you, business cards, telephone conversations, e-mails, internet including your use of our social media pages (e.g. Facebook, LinkedIn, twitter), and video.
In some circumstances Layburn Hodgins may be provided with personal information about an individual from a third party, for example a report provided by a professional or a reference from another person.
Layburn Hodgins also collects information from our websiteย layburn.co.nzย through receiving client assessment forms and emails. We also use third parties to analyse traffic at that website, which may involve the use of cookies. We seek to ensure our website remains secure, however despite our best endeavours please be aware that the internet is not a secure environment and transmission of personal information via the internet is at your risk.
How do we use and disclose your personal information?๐
Layburn Hodgins may use and disclose your personal information for the primary purpose for which it is collected, for reasonably expected secondary purposes which are related to the primary purpose and in other circumstances authorised by the Privacy Act.
In general, Layburn Hodgins uses and discloses your personal information for the following purposes:
- To verify your identity;
- To conduct our business;
- To check legal or commercial conflicts;
- To provide our services to you;
- To provide you with marketing materials and publications where you have consented to us doing so;
- To respond to communications from you, including a complaint;
- To purchase from you;
- To comply with our legal obligations;
- To improve the services and products that we provide to you;
- To undertake credit checks of you (if necessary)
- To invoice you and collect money that you owe to us, including authorising and processing credit card transactions;
- To conduct research and statistical analysis;
- To protect and enforce our legal rights and interests, including defending any claim and / or registering your name for credit reporting purposes;
- Where you have applied for employment by Layburn Hodgins, or for recruitment purposes;
- For any other purpose authorised by you or the Act.
Layburn Hodgins may disclose your personal information, in certain circumstances in accordance with the law to:
- Other companies or individuals who assist us in providing services who perform functions on your behalf (for example a barrister);
- Other companies or individuals who support our services and products, including any person that hosts or maintains and underlying IT system or data centre that we use to provide the website or other services or products;
- A credit reference agency for the purpose of credit checking you;
- Courts, tribunals, Inland Revenue and regulatory authorities;
- Other third parties (for anonymised statistical information);
- Any person authorised by the Act, or if required pursuant to the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, or another law.
- Any other person authorised by you.
How we manage and protect your personal information๐
The Privacy Act requires Layburn Hodgins to take reasonable steps to protect the security of personal information safe from loss, unauthorised activity, or other misuse.
We may hold your personal information in electronic and / or hard copy form. It is our policy to retain a copy of your electronic file following completionand in certain cases (and in relation to certain documents) a hard copy may be kept at our office or a premises outside our office such as a data storage facility which may be operated by an independent service contractor. Please see our Terms of Engagement, Conduct, Client Care for further information on our file and document storage policies. Where Layburn Hodgins no longer requires your personal information for the purpose in which it was collected or as otherwise permitted or required by law, we will take reasonable steps to destroy it where requested by you to do so.
How do we keep personal information accurate and up-to-date?๐
Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction of your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.
We reserve the right to charge a fee for providing access to or correcting your personal information held by us.
